ఈనాడు, దిల్లీ: రాష్ట్రంలోని 23 నగరపాలక, పురపాలక సంస్థలు, నగర పంచాయతీల్లో సమీప గ్రామాలను చేరుస్తూ 2021లో వైకాపా ప్రభుత్వం చేసిన ఏపీ మున్సిపల్‌ లాస్‌ (ఎమెండ్‌మెంట్‌) యాక్ట్‌ 2021ను సవాల్‌ చేస్తూ దాఖలైన పిటిషన్లలో సుప్రీంకోర్టు రాష్ట్ర ప్రభుత్వానికి నోటీసులిచ్చింది. అయితే ఈ అంశం తేలేవరకూ ప్రస్తుతం ఆ మున్సిపాలిటీలకు జరగబోయే ఎన్నికలపై స్టే ఇవ్వడానికి జస్టిస్‌ పీఎస్‌ నరసింహ, జస్టిస్‌ అలోక్‌ అరాధేలతో కూడిన ధర్మాసనం నిరాకరించింది. ఈ కేసును దీర్ఘకాలం పెండింగ్‌లో పెట్టకుండా త్వరగా విచారిస్తామని స్పష్టం చేసింది. తుది విచారణను నవంబరు 17కు వాయిదా వేస్తూ బుధవారం ఉత్తర్వులు జారీ చేసింది.
దీంతో రాజమహేంద్రవరం, కాకినాడ, మంగళగిరి-తాడేపల్లి, శ్రీకాకుళం కార్పొరేషన్లు, రాజాం, ఆమదాలవలస, చింతలపూడి, భీమవరం, తణుకు, తాడేపల్లిగూడెం, పాలకొల్లు, గుడివాడ, తాడిగడప, బాపట్ల, పొన్నూరు, కందుకూరు, పొదిలి, కావలి, అల్లూరు, గూడూరు, శ్రీకాళహస్తి, బి.కొత్తకోట పురపాలక, నగరపంచాయతీల ఎన్నికలకు మార్గం సుగమమయింది.
వైకాపా ప్రభుత్వం పలు గ్రామ పంచాయతీలను సమీపంలోని 20 పుర, నగరపాలక సంస్థలు, నగర పంచాయతీల్లో విలీనం చేస్తూ.. 2021 జూన్‌ 9న గెజిట్‌ నోటిఫికేషన్‌ విడుదల చేసింది. గ్రామ పంచాయతీల తీర్మానం లేకుండా ఇలా విలీనం చేయడం రాజ్యాంగ విరుద్ధమని, అందువల్ల వీటిని కొట్టేయాలంటూ ఎద్దుల సుబ్బారెడ్డి, వల్లేపల్లి వెంకట సుబ్రహ్మణ్యం, తోట రాధాకృష్ణమూర్తి 2021లో హైకోర్టును ఆశ్రయించారు. విచారణ జరిపిన హైకోర్టు డివిజన్‌ బెంచ్‌ గ్రామాల విలీనంలో ప్రభుత్వం అధికార పరిధిని అతిక్రమించలేదంటూ ఈ నెల 1న తీర్పు వెలువరించింది. దాన్ని సవాల్‌ చేస్తూ పిటిషనర్లు సుప్రీంకోర్టును ఆశ్రయించారు.
బుధవారం విచారణలో పిటిషనర్ల తరఫున సీనియర్‌ న్యాయవాది రఘునందన్‌రావు వాదనలు వినిపిస్తూ.. ఆర్టికల్‌ 243క్యూ(2) ప్రకారం గ్రామాలను సమీప మున్సిపాలిటీల్లో విలీనం చేసే విషయంలో రాష్ట్రాల శాసననాధికారాలపై పరిమితులు ఉన్నాయని రఘునందన్‌రావు పేర్కొన్నారు. రాష్ట్ర ప్రభుత్వం తనకు ఇష్టం వచ్చినట్లు ఏ గ్రామాన్నయినా మున్సిపాలిటీలో విలీనం చేయడానికి వీల్లేదన్నారు. మరో సీనియర్‌ న్యాయవాది ఎల్‌.నరసింహారెడ్డి వాదనలు వినిపిస్తూ గ్రామాల విలీనం ఆర్టికల్‌ 243 క్యూ(2) కింద పేర్కొన్న నిబంధనల ప్రకారం చేయలేదన్నారు.
2021లో హైకోర్టులో ఈ పిటిషన్లు వేసినప్పటి నుంచి ఆ మున్సిపాలిటీల ఎన్నికలపై స్టే కొనసాగిందని, ఇప్పుడు కూడా స్టే ఇవ్వాలని రామకృష్ణప్రసాద్‌ కోరారు. మున్సిపాలిటీల్లో చేర్చడం వల్ల పంచాయతీరాజ్‌ చట్టం ప్రకారం ఈ గ్రామాలకు కేంద్ర ప్రభుత్వం నుంచి వచ్చే నిధులు ఆగిపోతాయని సీనియర్‌ న్యాయవాది చల్లా కోదండరాం పేర్కొన్నారు.
రాష్ట్ర ప్రభుత్వం తరఫున సొలిసిటర్‌ జనరల్‌ తుషార్‌ మెహతా వాదనలు వినిపిస్తూ గ్రామీణ ప్రాంతాలు పట్టణాలుగా రూపాంతరం చెందుతున్నప్పుడు ఆర్టికల్‌ 243 క్యూ(1) ప్రకారం వాటిని మున్సిపాలిటీల్లో చేర్చొచ్చన్నారు. ఇక్కడ చుట్టుపక్కల గ్రామాలను అప్పటికే ఉన్న మున్సిపాలిటీల్లో కలిపారే తప్ప గ్రామాలను మున్సిపాలిటీలుగా కొత్తగా ప్రకటించలేదని ధర్మాసనం దృష్టికి తీసుకొచ్చారు.
వాదనలు విన్న జస్టిస్‌ పీఎస్‌ నరసింహ స్టే విధించడానికి నిరాకరించారు. విలీనం చేసేటప్పుడు ఆర్టికల్‌ 243 క్యూ(2) నిబంధనలన్నీ పాటించారో లేదో లోతుగా పరిశీలించడానికి నోటీసులు జారీ చేస్తామన్నారు. అయితే ఎన్నికలపై మధ్యంతర స్టే ఇవ్వలేమని, స్టే ఎంత కాలం కొనసాగిస్తామంటూ విచారణ ముగించారు. ఈ పట్టణ స్థానిక సంస్థలకు జరిగే ఎన్నికలు కోర్టు తుది తీర్పునకు లోబడి ఉంటాయన్నారు.

Senior advocate Raghunandan Rao, speaking on behalf of the petitioners in Wednesday's hearing, stated that according to Article 243Q(2), there are limitations on the legislative powers of the states in the matter of merging villages into nearby municipalities. He said that the state government cannot merge any village into the municipality as it likes. Another senior lawyer L. Narasimha Reddy argued that the merger of villages was not done as per the provisions mentioned under Article 243 Q(2).
Since the petitions were filed in the High Court in 2021, the stay on the elections of those municipalities continued and Ramakrishna Prasad asked for a stay even now. Senior advocate Challa Kodandaram stated that as per the Panchayat Raj Act, these villages will stop receiving funds from the central government due to inclusion in municipalities.
On behalf of the state government, Solicitor General Tushar Mehta argued that when rural areas are transformed into towns, they can be included in municipalities under Article 243 Q(1). It was brought to the court's attention that the villages around here were not declared as new municipalities unless they were merged into the existing municipalities.
Justice PS Narasimha, after hearing the arguments, refused to impose a stay. Notices will be issued to examine in depth whether all the provisions of Article 243 Q(2) have been followed during the merger. But the investigation concluded that an interim stay cannot be given on the election and how long the stay will continue. Elections to these urban local bodies will be subject to the court's final verdict.
