Not a denial of justice...

Similar to those afflicted with pain, those in legal trouble want relief as soon as possible and at low cost. Less than two decades ago, Bhaironsingh Shekhawat as the Vice President emphasized that delay in the delivery of justice is not only denial of justice but also destruction of the rule of law. If the process of getting justice is laborious, slow and hopeless, litigants lose faith in the system itself. It has been ten years since the Supreme Court warned that 'justice for all' will remain a dry slogan if citizens do not get speedy justice. The 'Supreme' has made it clear that speedy trial is an integral part of the right to life. But with the cases waiting for salvation for years and the increasing cost burden on the common man, that constitutional standard is being watered down. With the Opattana Temalani lawsuits- as Logada Nyayapalika commented, our criminal justice system is becoming a punishment!
The number of pending cases in lower courts has crossed 5.15 crores. If the pending cases in High Courts and Supreme Courts are counted together, it will exceed 5.8 crores. Courts are overloaded with cases piling up in heaps. In order to dissolve those hills, the central government has recently directed nineteen law universities to codify the methods to be followed to make legal services available to all in a fast, efficient and impartial manner across the gaps. Although this is a welcome initiative, it is the main reason why the cases remain so pending, Nirudu said in the Lok Sabha. It is clear that the problem is getting worse due to the lack of sufficient number of judges for the population. The Law Commission, which had said in 1987 that there should be at least 50 judges for every 10 million people, recommended that the ratio be increased to 107 by the year 2000. However, studies reveal that there are still only 15 judges per ten million people in the country. If the governments focus on increasing the number of judges enough to meet the population explosion, especially on filling up the vacancies in the district and subordinate courts - people will not have to give up hope on speedy justice!
The Parliamentary Standing Committee had previously reported another plight of pending cases leading to grazing. The committee broke the pot that the biggest litigants in our country are the central and state governments... almost half of the unresolved lawsuits are related to the governments. It has analyzed that due to this there is an inordinate delay in getting justice to the common man and it is also putting a huge burden on the exchequer. Governments should provide direction to the mechanism for adjudicating those claims in alternative redressal mechanisms. In order to reduce the cases coming to the courts, as suggested by Justice N.V.Ramana as the CJI- the local bodies, revenue and police departments should abide by the laws and work efficiently and impartially. Legislatures should make clear laws that are in the public interest. Priority should be given to increase infrastructure and digital facilities in courts!
