ఈనాడు, అమరావతి: ‘స్థానిక’ ఎన్నికల్లో కల్పించిన బీసీ రిజర్వేషన్లు సుప్రీంకోర్టు ఆదేశాలకు అనుగుణంగా లేవని గుంటూరు జిల్లా చుండూరు మండలం ఆలపాడుకు చెందిన డాక్టర్‌ సీహెచ్‌ రవికుమార్‌ హైకోర్టులో పిల్‌ వేశారు. పురపాలకశాఖ జారీచేసిన జీవో 251, పంచాయతీరాజ్‌శాఖ ఇచ్చిన జీవో 153, డెడికేటెడ్‌ కమిషన్‌ నివేదికను ప్రభుత్వం ఆమోదిస్తూ ఈ నెల 10న జారీచేసిన జీవో 17ను రద్దు చేయాలని కోరారు. గురువారం జరిగిన విచారణలో పిటిషనర్‌ తరఫున న్యాయవాది వివేకానంద విరూపాక్ష వాదనలు వినిపించారు. ‘సుప్రీంకోర్టు విధించిన ట్రిపుల్‌ టెస్ట్‌ నిబంధనలను పాటించకుండా బీసీలకు రిజర్వేషన్లు నిర్ణయించారు.
సమగ్ర కుటుంబ సర్వే డేటా ఆధారంగా విశ్రాంత ఐఏఎస్‌ అధికారి రాజీవ్‌ రంజన్‌మిశ్రా నేతృత్వంలోని డెడికేటెడ్‌ కమిషన్‌ రాష్ట్ర ప్రభుత్వానికి నివేదిక ఇచ్చింది. ఆ నివేదికను ప్రభుత్వం బయటపెట్టలేదు. దానిపై ప్రజల నుంచి అభ్యంతరాలను స్వీకరించకుండానే ఆమోదించి బీసీ రిజర్వేషన్లను ఖరారు చేసింది. సరైన డేటాను సేకరించకుండా రిజర్వేషన్లు నిర్ణయించటం వల్ల ఎస్సీ, ఎస్టీ, బీసీ వర్గాలు నష్టపోతున్నాయి. సుప్రీంకోర్టు, హైకోర్టు ఆదేశాలకు అనుగుణంగా రిజర్వేషన్లను ఖరారు చేయలేదు. కాబట్టి ఎన్నికల నోటిఫికేషన్‌ జారీచేశాక కూడా ప్రక్రియను నిలువరించవచ్చు. ఈ విషయంపై సుప్రీంకోర్టు త్రిసభ్య ధర్మాసనం గతంలో ఉత్తర్వులిచ్చింది’ అని కోర్టు దృష్టికి తీసుకొచ్చారు.
కోర్టు తీర్పులకు లోబడే రిజర్వేషన్ల నిర్ణయం: ఏజీ
రాష్ట్ర ప్రభుత్వం తరఫున అడ్వొకేట్‌ జనరల్‌(ఏజీ) దమ్మాలపాటి శ్రీనివాస్ వాదనలు వినిపించారు. ‘ఇప్పటికే ఎన్నికల నోటిఫికేషన్‌ జారీ అయ్యింది. ఈ దశలో న్యాయస్థానాలు జోక్యం చేసుకోవటానికి వీల్లేదు. ఈ విషయాన్ని సుప్రీంకోర్టు చెప్పింది. పిల్‌కు విచారణార్హత లేదు. కేవలం సమగ్ర కుటుంబ సర్వేలో సేకరించిన డేటా ఆధారంగా రిజర్వేషన్లు ఖరారు చేశామనే పిటిషనర్‌ వాదనల్లో వాస్తవం లేదు. ఇతర అంశాలనూ పరిగణనలోకి తీసుకున్నాం. డెడికేటెడ్‌ కమిషన్‌ నివేదికను ప్రభుత్వం ఆమోదించింది. అందులోని సూచనలు, సుప్రీంకోర్టు, హైకోర్టు తీర్పులకు లోబడి మొత్తం రిజర్వేషన్లు 50శాతానికి మించకుండా జీవోలు జారీచేశాం. పిల్‌ను కొట్టేయండి’ అని విజ్ఞప్తి చేశారు. ఇరువైపులా వాదనల అనంతరం తీర్పును రిజర్వ్‌ చేస్తున్నట్లు ప్రధాన న్యాయమూర్తి జస్టిస్‌ లిసా గిల్, జస్టిస్‌ చల్లా గుణరంజన్‌తో కూడిన ధర్మాసనం ప్రకటించింది.
ఈనాడు, అమరావతి: స్థానిక సంస్థల ఎన్నికల్లో నామినేషన్ల దాఖలు సమయంలో అవరోధాలు ఏర్పడినప్పుడు ఎన్నికల అధికారులను ఆశ్రయించవచ్చని అభ్యర్థులకు హైకోర్టు స్పష్టం చేసింది. అభ్యర్థుల వినతులపై నామినేషన్ల గడువు ముగిసేలోపు తగిన ఉత్తర్వులు జారీచేయాలని అధికారులకు సూచించింది. న్యాయమూర్తి జస్టిస్‌ ఎం.కిరణ్మయి గురువారం ఈ మేరకు ఉత్తర్వులిచ్చారు. ప్రాదేశిక, మున్సిపాలిటీల ఎన్నికల సందర్భంగా నామినేషన్ల దాఖలుకు సాధారణ నామినేషన్‌ కేంద్రాలకు అదనంగా ఆయా జిల్లాల ఎన్నికల అధికారుల వద్ద ఒక్కో ప్రత్యేక కేంద్రాన్ని ఏర్పాటు చేసేలా ఆదేశాలివ్వాలంటూ వైకాపా రాష్ట్ర ప్రధాన కార్యదర్శి లేళ్ల అప్పిరెడ్డి హైకోర్టులో వ్యాజ్యం వేశారు. బుధవారం జరిగిన విచారణలో రాష్ట్ర ప్రభుత్వం తరఫున ఏజీ దమ్మాలపాటి శ్రీనివాస్, రాష్ట్ర ఎన్నికల కమిషన్‌(ఎస్‌ఈసీ) తరఫున న్యాయవాది ఎన్‌.అశ్వనీకుమార్‌ వాదనలు వినిపించారు. నామినేషన్ల దాఖలు సమయంలో ఎవరికైనా అవరోధం కలిగితే సంబంధిత ఎన్నికల అధికారిని ఆశ్రయించవచ్చని చెప్పారు. జిల్లా కేంద్రంలో ప్రత్యేక నామినేషన్‌ కేంద్రం ఏర్పాటుకు నిబంధనలు అనుమతించబోవన్నారు. బుధవారం ఈ వ్యాజ్యంపై వాదనలు ముగిశాయి. న్యాయమూర్తి గురువారం తీర్పు వెలువరించారు.

నామినేషన్ల దాఖలు వ్యవధిని ఆరు రోజులకు పెంచేలా రాష్ట్ర ఎన్నికల కమిషన్‌ను ఆదేశించాలని కోరుతూ భారత చైతన్య యువజన పార్టీ(బీసీవైపీ) అధ్యక్షుడు బోడె రామచంద్రయాదవ్‌ హైకోర్టులో వ్యాజ్యం వేశారు. అభ్యర్థులకు సకాలంలో నో డ్యూస్, కుల ధ్రువపత్రాలు జారీచేసేలా అధికారులు, ఎస్‌ఈసీని ఆదేశించాలని కోరారు. గురువారం కోర్టు ప్రారంభం కాగానే పిటిషనర్‌ తరఫు న్యాయవాది ఉమేశ్‌చంద్ర స్పందిస్తూ.. ఈ వ్యాజ్యంపై అత్యవసరంగా విచారణ జరపాలని విజ్ఞప్తి చేశారు. న్యాయమూర్తి జస్టిస్‌ కిరణ్మయి స్పందిస్తూ.. శుక్రవారం విచారణ జరుపుతామన్నారు.
ఎన్నికల బరిలో నిలవాలనుకునే అభ్యర్థుల విజ్ఞప్తి మేరకు రాష్ట్రవ్యాప్తంగా వారిపై నమోదైన కేసుల వివరాలను వెంటనే ఇచ్చేలా పోలీసులు, రాష్ట్ర ఎన్నికల కమిషన్‌ను ఆదేశించాలని వైకాపా రాష్ట్ర ప్రధాన కార్యదర్శి లేళ్ల అప్పిరెడ్డి గురువారం హైకోర్టులో పిటిషన్‌ వేశారు. ఆయన తరఫు న్యాయవాది ఈ వ్యాజ్యంపై అత్యవసరంగా విచారణ జరపాలని కోరారు. శుక్రవారం విచారణ జరుపుతామని న్యాయమూర్తి జస్టిస్‌ వి.సుజాత తెలిపారు.

Today, Amaravati: Dr. CH Ravikumar of Alapadu of Guntur District Chunduru Mandal has filed a PIL in the High Court that the BC reservations provided in the 'local' elections are not in accordance with the Supreme Court orders. SC, ST and BC categories are suffering due to reservation being decided without proper data collection. Reservations were not finalized as per the orders of Supreme Court and High Court. So even after issuing the election notification, the process can be stopped. It was brought to the attention of the court that the three-judge bench of the Supreme Court had previously ordered on this matter.

Advocate General (AG) Dhammalapati Srinivas argued on behalf of the state government. The election notification has already been issued. Courts cannot interfere at this stage. The Supreme Court has said this. PIL is not maintainable. There is no truth in the contentions of the petitioner that the reservation was finalized only on the basis of the data collected in the comprehensive family survey. We have taken other factors into consideration. The government accepted the report of the dedicated commission. According to the instructions, the judgments of the Supreme Court and the High Court, the total reservation has not exceeded 50 percent. Pop the pill' he appealed. Lawsuit to extend nomination filing period
Bharat Chaitanya Yuvajana Party (BCYP) President Bode Ramachandra Yadav has filed a lawsuit in the High Court seeking an order to the State Election Commission to extend the nomination filing period to six days. They requested the authorities to direct the SEC to issue no-dues and caste certificates to the candidates on time. When the court started on Thursday, Umeshchandra, the lawyer for the petitioner, responded. Judge Justice Kiranmayi responded that the inquiry will be held on Friday.
On the request of the candidates who want to stand in the election ring, Vaikapa State General Secretary Lella Appireddy filed a petition in the High Court on Thursday to order the police and the State Election Commission to immediately provide the details of the cases registered against them across the state.
