Data Protection: Who protects data in disasters?

All our Aadhaar details, UPI transactions, Lands, assets, financial information, censuses... all this is an ocean of data! Even if it is safe with the government, what if some unexpected threat comes up? What if natural calamities occur in the country, wars occur, internet and telecom systems stop, servers fail? Government and people's activities are stopping! The country freezes! Don't get into a crisis! The central government has decided to set up data embassies to deal with such unexpected events. The first step towards this was taken recently during the UAE President's visit to India. 

Data Embassy is not an ordinary diplomatic office. A country stores its critical digital data in a center abroad. Due to this, even in the face of geopolitical crises like cyber attacks, natural disasters and wars, operations can be continued without any disruptions. This is made possible by keeping the critical database securely hidden in a trusted host country. A data embassy on foreign soil is maintained by that country. Works within the scope of the laws there. Otherwise, control over the data stored on the servers in the embassy and access to that information rests with the home country and its representatives. Protection from local laws. Search warrants and seizures are invalid. The country cannot ask for the information or give orders on it. It acts as a cloud enclave.

Strategic priority

According to the Vienna Convention on Diplomatic Relations, a country... They all apply to a data embassy which provides the same security, legal protection and immunity from trespass to a foreign diplomatic post established on its soil. The UAE has to provide the highest level of security to the embassy that keeps sensitive information related to India in their country. In turn, UAE will set up a data center hub in our country.

Foreign Secretary Vikram Misri explained that there is a possibility of securing information of strategic value of national importance in Data Embassy. This is a new thing and legal procedures are being prepared for this. In fact, in the 2023-24 budget, Finance Minister Nirmala Sitharaman announced that proposals for data embassies would be considered. The proposal has strategic importance as part of the Digital India Mission. In the context of our country already moving rapidly towards a paperless governance system, natural disasters and large-scale cyber attacks are more likely to pose serious threats. By setting up a digital embassy in UAE, our country is geographically distant and digitally accessible as a hotspot backup center. A hotsite backup center is a fully prepared center to take over within minutes if the main data center fails in data recovery in case of any disaster. It restores services within minutes or hours immediately after a disaster. Realtime updates data changes regularly. This will not cause any disruption to operations. It is a part of disaster management strategy. All necessary hardware and software network facilities are readily available at the main centre. It plays a key role in providing uninterrupted services like government activities, public services, banking, health and e-commerce.

Digital Corridor

India is asking various countries to set up digital embassies in our country. There is a possibility that UAE will arrange it first. It seems to have been proposed in Gift City, Gujarat. There are possibilities of connecting India and UAE Digital Embassy project to IMEC (India Middle East Europe Economic Corridor). This digital corridor will support seamless, cross-border data supply. E-embassies allow data to travel within sovereign control. A bilateral agreement like this could herald the beginning of trust-based digital alliances. It will enable the creation of digital infrastructure by governments without relying entirely on big tech platforms.
