Father Deny His Daughter Share in HUF Property for Marrying Against Wishes

Father Deny His Daughter Share in HUF Property for Marrying Against Wishes

Ramya's parents from Hyderabad Married against her will. Infuriated by this, the father decided that he would not give her a share in the HUF property of their family. With this, Ramya is ready to fight. Can the father revoke the daughter's right to property because she does not listen to her parents? What does the law say? Let's explore this interesting point.

Father has no legal authority to deny daughter a share in Hindu Undivided Family (HUF) property on the ground that she is married against the wishes of family members. According to the 2005 amendment to the Hindu Succession Act, 1956, daughters have equal rights with sons in patrilineal family property by birth.

Can partition be sought?

Section 6 of the Hindu Succession Act provides that a daughter also has equal property rights in a Hindu joint family. She has the same rights and responsibilities over the property as the son. Getting married or marrying without parental consent does not nullify this right. An eligible daughter can seek division of family property for her share.

No need to break up the family

Just as one member demands his share, the entire HUF need not necessarily be liquidated, says financial expert Balwant Jain. Other members may continue in the family system. However, rights should be ascertained by examining the nature of the property, previous valid partitions and relevant documents.

Caution in Taxes

The key point is that partial partition is not recognized under the Income Tax Act. The tax liability on property income can become complicated until the relevant Income Tax Officer finds that the HUF has been fully partitioned even if the daughter is allotted a share in the property. Hence it is necessary to take legal advice before property division.
